The user acknowledges and accepts that all industrial and intellectual property rights over the content and/or any other elements included by S.I. on this Website (including, purely by way of example, without being confined thereto, all elements comprising the visual appearance, graphical image and other sensory stimuli of the website or its "look and feel": trademarks, logos, trading names, texts, images, graphics, designs, sounds, databases, software, flowcharts, presentation, browsing architecture and source code of webpages) are the property of S.I.
Access to the Website in no way constitutes any type of permission, waiver, transfer, licence or total or partial assignment of said rights by the holders thereof, unless explicitly established otherwise. These terms and conditions for use of the Website do not vest in USERS any other right of usage, alteration, exploitation, reproduction, distribution or public communication of the Website and/or of its content other than as explicitly here provided.

This Website may make use of links to other webpages or sites. S.I. accepts no liability either for the content or the security measures adopted by any other web page or site accessed via this Website, the party concerned bearing full responsibility for any access thereto.
Nor is any guarantee given as to the absence of viruses or other elements in the content linked to from the Smart Insurance Website which could cause alterations in the computer system (hardware and software) and/or the documents or files of the User. S.I. declines all liability resulting from any damage of any kind caused by all the foregoing.
5. Social media
We hereby inform you that S.I. has a social media presence. The processing of the data of persons who become followers via social media (and/or who perform any linkage or action for connection via social media) with regard to the official pages of S.I. shall be governed by this subsection, and by any conditions of use, privacy policies and access regulations corresponding to the social media platform in each case, as accepted in advance by the User.
S.I. will process your data in order properly to administer its social media presence, informing you of S.I. activities, products or services, and for any other purpose permitted by the Social Media regulations.
The following content must not be published:
- Any that would be deemed unlawful under national, EU or international regulations or any involving activities that would be deemed unlawful or in breach of the principles of good faith.
- Any that would breach fundamental personal rights, constitute a lack of online civility, that would disturb or potentially generate negative opinions in our users or third parties, and in general any content that Smart Insurance might deem inappropriate.
- And, in general, any content that would be in breach of principles of legality, decency, responsibility, protection of human dignity, protection of legal minors, protection of public policy, protection of private life, protection of consumers and intellectual and industrial property rights.
S.I. likewise reserves the right without prior notice to remove any content it might deem inappropriate from the website or from the corporate social media platform.
6. Modification of the Terms and Conditions of Use, Privacy Policy and Data Protection
The Data Controller reserves the right at any time and without prior notice to modify these terms, conditions and privacy policies in order to adapt them to any developments in legislation or case law, and any modifications or practices in the industry, and the User should therefore periodically consult these terms, conditions and policies in order to confirm or ascertain the existence of any changes thereto, taking the most recent update as the point of reference.
7. Advertising communications
By accepting these terms, conditions and policies, and in particular by sending their personal data to Smart Insurance, the User explicitly agrees that Smart Insurance may perform the following activities and/or actions, unless otherwise indicated when any product and/or service of Smart Insurance is contracted or subscribed to, or as a result of a subsequent revocation of the consent initially granted:
The sending of commercial and/or promotional communications on paper, informing the User of activities, promotions, advertising, news, offers and other information regarding the services and products connected with the commercial activity of Smart Insurance.
- The sending of commercial communications via electronic channels, informing the User of activities, promotions, advertising, news, offers and other information regarding the services and products of Smart Insurance that are the same as or similar to those initially contracted by or of interest to the User.
- The storage of data for the periods set out in the applicable provisions.
Without prejudice to all the foregoing, commercial and/or advertising communication will not be deemed to include any information sent by Smart Insurance (including via electronic means) to users of Smart Insurance in order to perform, execute and/or develop any service provision subscribed or contracted by the User, even if not subscribed via electronic channels, nor any other tasks, actions and/or activities derived from said contractual and/or commercial relationship.
Data subjects may revoke their consent to receive commercial communications by sending a letter to Smart Insurance Correduría de Seguros S.L., at its registered office at calle Alaba, número 140, 2º 4ª, Barcelona, Spain or by sending an unsubscribe email to the address [email protected] with the subject line “BAJA”.
8. Contractual procedures to be followed
There are in all cases four contractual procedures to be followed to arrange a policy via this website:
- The first step is to answer the questions about the travel and the travelers.
- Secondly, once the insurer's proposal has been presented, decide whether to customize the cover and limits insured, and continue.
- The details of the insureds must thirdly be entered.
- Lastly, payment will be made, giving rise to automatic confirmation by email, with the contract attached.
9. Availability of documentation
Smart Insurance does not store policy documents or contracts. The Customer receives the documents at the email address as the conclusion of the contractual process, and if any corrections need to be made to the contract, it will have to be cancelled and a new contract issued.
10. Identification and correction of errors in data entry
Smart Insurance provides Users of the website with the following resources in order to prevent incorrect data from being entered:
- Basic format validations of the key fields (ID document number, telephone number, email address).
- The User will be shown a summary of their order in the final contractual step, allowing one last check to be performed.
- Issuance and delivery of the documentation with the specific conditions and policy schedule arranged by the customer at the moment of payment.
11. Language of documentation
All documentation generated by Smart Insurance will be drawn in English.
